Electronic signatures are recognised under South African law
The Electronic Communications and Transactions Act recognises electronic signatures for ordinary business agreements in South Africa. Mongwalo produces standard electronic signatures under that Act, which are appropriate for everyday B2B contracts such as NDAs, supplier agreements, employment letters and ordinary leases.
A small set of documents, such as wills, transfers of immovable property and leases of land running longer than 20 years, carry additional formal requirements. For those, or for any high-stakes agreement, confirm the signing requirements with your attorney first.
Mongwalo does not produce advanced electronic signatures. An advanced electronic signature requires an accredited authentication provider under the ECT Act. If a document legally requires an advanced electronic signature, use an accredited provider for that document.
Your documents are sealed, encrypted in transit and auditable
Sealed documents
Every completed document is sealed with a digital signing certificate. If the PDF is altered after sealing, the seal no longer validates.
Audit trail
The platform records who was invited, who viewed, who signed and when. The audit trail travels with the document.
Encrypted in transit
All traffic to and from the platform runs over HTTPS.
Storage
Documents are stored in Cloudflare R2 object storage and platform data lives in a Postgres database on Mongwalo's own server.
POPIA
Mongwalo is operated under the Protection of Personal Information Act. Personal information is collected only to run the signing process. Questions: [email protected].
ECT Act
Signatures are standard electronic signatures under the ECT Act, suited to everyday business contracts. Not advanced electronic signatures.
Lease a signing portal in your own branding
Mongwalo is set up as a branded portal with your logo, your colours and your own domain, so your clients sign on a platform that looks and feels like yours. Pricing is provided on request.
